WILLS
Wills and LPA's
Making a will is one of the most important tasks which any of us can undertake. A will can ensure that not only will your estate be passed to your designated beneficiaries but it can for example, also direct at what point your loved ones will receive any gift, which you may for example, wish to correspond with certain landmarks in their life, such as starting university or buying their first house. A will can appoint guardians of any minor children and can provide an income during their minority. In simple terms, a professionally drafted will ensures that there is less likelihood of dispute, that all your wishes are recorded in a clear and concise manner and that loved ones can navigate through the process of administering an estate smoothly at a time when they will be experiencing considerable anxiety and upset.
At Hart Ford Solicitors Limited we recognise that all clients have different needs, such as cohabitating couples and those with second families and we provide a bespoke service to accommodate your individual circumstances.
Our services include:
• drafting wills which reflect your family circumstances (including the use of trusts within the will itself)
• administering a deceased’s estate
• dealing with foreign assets
• assisting with calculation and payment of Inheritance Tax
• advising on disputes regarding the way an estate has passed either by will or intestacy
Living Wills
A living will or advance directive is a document which records what medical treatment you would wish to receive in the event of incapacity, for example by way of terminal or degenerative illness, to enable you to communicate your thoughts about these matters to your loved ones. If you wish to record your wishes should this situation arise then we can prepare a living will for you and this can then be lodged with your next of kin and your doctor.
Lasting Powers of Attorney
Physical infirmity and mental health issues are not the sole remit of the elderly. It is therefore important to ensure that your loved ones can look after your affairs if you become incapable of doing so yourself. A Lasting Power of Attorney (LPA) is a legal document that enables you to delegate the management of your affairs to a nominated person or persons. This can relate to either the management of your financial affairs and can be used either immediately or at some point in the future if you become incapacitated or can deal with your health and welfare although the latter can only be used in the event of your incapacity.
Hart Ford Solicitors Limited specialise in providing clear professional guidance on preparing LPA’s to ensure that your wishes are correctly recorded. In addition, we can register your LPA with the Office of the Public Guardian to ensure that it can be used immediately should you lose capacity in the future.
