Completing the purchase of a property is an important milestone, but the legal process does not end there. Once completion has taken place, our Post-Completion Department carries out several essential tasks to ensure that the property is correctly registered in your name and that all relevant tax obligations are fulfilled.
In England and Wales, the post-completion process generally involves two key stages: submitting the property tax return and registering the property with HM Land Registry.
1. Property Tax Return: SDLT in England and LTT in Wales
Following completion, we must submit the relevant property tax return if the purchase price or transaction value exceeds £40,000.
The applicable tax depends on where the property is located:
- England: Stamp Duty Land Tax (SDLT).
- Wales: Land Transaction Tax (LTT).
Both applications are completed online through the relevant tax authority’s portal. We use the information and documentation collected from you during the legal process to ensure that the return is completed accurately.
The tax return requires us to answer a series of questions about the transaction and the property. Based on the information provided, the applicable tax is calculated and the amount payable is determined.
It is important to understand that a tax return may still be required even if no tax is due. Where the transaction falls within the applicable reporting requirements, the return must be submitted regardless of whether the final tax calculation results in a payment.
The standard deadline for submitting the relevant return and paying any tax due is generally 14 days from the effective date of the transaction. However, our team aims to complete this stage as soon as possible, usually within a few working days of completion.
Meeting this deadline helps ensure that your purchase progresses smoothly to the next stage.
2. Registering Your Property with HM Land Registry
The second key stage is registering your ownership with HM Land Registry. This is an essential part of the conveyancing process, as it ensures that the official property register reflects your ownership.
Before we can submit the application, we may need to receive certain documents from the seller’s solicitors, including:
- TR1 or TP1 forms, depending on the type of transfer.
- The original mortgage deed, where applicable.
- The transfer deed and any other required supporting documents.
- The SDLT or LTT certificate confirming that the relevant tax requirements have been dealt with.
The exact documents required depend on the circumstances of the transaction.
We generally allow approximately 30–40 calendar days for this stage, although the application is prepared and submitted as soon as we have received all the necessary documents and completed the required checks.
Our team carefully reviews the documentation to ensure that the application is complete and ready for submission.
3. Waiting for HM Land Registry to Process the Application
Once the application has been submitted, we must wait for HM Land Registry to process it and update the property register.
Processing times vary depending on the Land Registry’s workload, the type of application and the circumstances of the individual case. Unfortunately, these timescales are outside our control.
During the registration process, HM Land Registry may raise additional questions or request further information or documentation. This is a normal part of the registration procedure and does not necessarily indicate that there is a problem with your purchase.
If any additional requirements arise, our team will review them and provide the necessary responses to help move the application forward.
Our aim is to ensure that any requests are dealt with promptly and that the registration can be completed as smoothly as possible.
4. Receiving Your Title Documents
Once HM Land Registry has completed the registration, our Post-Completion Department checks the updated property register to ensure that the details have been recorded correctly.
We then send the completed registration documents to you, our client. If you purchased the property with a mortgage, we also provide the relevant information to your mortgage lender, where required.
At this point, the post-completion process is complete, and you have confirmation that your ownership has been registered.
How Our Post-Completion Team Supports You
We understand that waiting for the final registration documents can feel like a long process, particularly after you have already completed your purchase and moved into your new home.
Our Post-Completion Department works diligently to ensure that all tax returns are submitted within the required deadlines, registration applications are prepared accurately, and any additional enquiries from HM Land Registry are addressed promptly.
Although we cannot control the time HM Land Registry takes to process an application, we can ensure that our part of the process is handled efficiently and professionally.
Our commitment is to make sure that every stage after completion is managed carefully, giving you peace of mind that the legal formalities of your property purchase are being taken care of.
